Supreme Court hints that it won't issue sweeping ruling on same-sex marriage - NBC Politics:

"There are some 40,000 children in California ... that live with same-sex parents, and they want their parents to have full recognition and full status.”"

So now the purported desires and voices of children is a legal argument?

Today, I mentioned in class that people who want every issue to be done at the Federal level are Imperialists. Some jesuits and other students got cranky. Then I said, then I asked them to explain the difference between an imperial government and a federal government...and the room got quite. Honestly though, I thought up that question in the moment and can't find a substantive answer for it myself. How would you define the difference between an imperial and a federal government? Is there a real difference at all, or is it just differences in regalia (labels and symbols)?.

Off the top of my head, a federal government is one that is limited by its constitutional powers, which the states have agreed to by covenant or bond, foedus...the word that feudal comes from.

An imperial government recognizes no law but itself.

About the Federal level, it does seem to me that most Americans, especially liberals, no longer have any feel for the federalism that created the country, one of united states. The state has simply become a local subsidiary of the Feds. And with the mania for equality, only the Feds can make laws that insure "equality for all."

yes, I agree. that was why i used the term "imperial"- I knew it was kind of ridiculous to use the term in this context but I wanted to (1) provoke them and (2) to bring up the theme of one culture forcing its way of life on those who do not want it - like russification, or "civilizing the heathen"s (which many of them tend to view people from the South/Southwest as). I will never get over how they have the hubris to tell me (and other students from my region) how we "really" feel. They psychologize away why I don't actually feel the things that I do, and then proceed to tell me how I "actually" think. Like this one female student who criticized a feminist theology that stated that women are demeaned by speaking of God with male pronouns and are denigrated by "not being allowed to be priests", saying that she has never felt offended or demeaned or oppressed by these things - and then they proceeded to tell her that she has just been beaten down and that just because she doesn't think that she isnt being degraded doesn't change the fact that she actually is being degraded; I felt so bad for her because she was really upset by the whole event. The hurbis, dogmatism, and self-assurance of these people surpass most baptist ministers I know. And then the smiles and babying turns into satanic aggression when you disagree with them.
